Disputes are horrible things that can trouble your thoughts every day, cost an unreasonable sum of money and/or time and can sometimes seem intractable or unlikely to lead to a good outcome for you. And, if your dispute is already in litigation, its resolution will effectively be public and in the hands of a third party who is totally out of your control… the Judge decides! What will the judge decide? Will your argument have been fully presented and understood? What surprises will occur along the way that could throw your argument off course? During the litigation process, can you control how your opponent responds, or could they drive up your costs’ burden and sap your or your business’s resources in ways that you would prefer they didn’t?

Effective mediation can solve these issues, lead to a speedier outcome and preserve relationships if the participants wish to do so.

86% of disputes referred to mediation end in settlement, the majority of those are settled on the day of the mediation itself*. Settlement is in the control of both participants from start to finish and proceeds on a common basis of confidentiality. Settlement can only be reached if both participants are happy to do so and, unlike in Court, the participants decide for themselves what the settlement looks like.

I have more than 30-years’ experience working professionally with a very wide range of people to find mutual interests and avoid, mitigate or resolve disputes or the potential for disputes. The first four of these are soft skills backed up by very sound business and law experience and knowledge that help me work with the parties to discover and match their objectives and concerns.

The fifth, avoiding future disputes, can be soft as well but is usually within a formal framework – often intended to be legally binding – designed to last for the long-term. Long-term design requires understanding the business in which parties are operating and the creative application of experience and analytical, legal and drafting skills to a future that will have a number of contingencies.

I have worked to help people achieve their goals in and with family businesses, entrepreneurial ventures, partnerships and single- and multi-founder businesses (new and old), start-ups and growth businesses, as well as foundations and unincorporated associations.
